Shipping Policy

Order processing
Orders are usually processed within 1-2 business days once payment is confirmed. If there’s any delay (low stock, address issue, etc) we’ll contact you using the email you provided at checkout.

Shipping times
Shipping times depend on your location. You’ll see estimated delivery at checkout when you enter your address. These are estimates, not guarantees.

Tracking
You’ll receive a tracking link once your order has been handed to the carrier. It may take up to 24 hours for the tracking page to start updating.

International orders
Import duties, taxes, or customs fees (if any) are the buyer’s responsibility. We can’t control delays caused by customs or the carrier once your package has left our fulfilment location.

Lost or damaged in transit
If your package arrives damaged or doesn’t arrive, contact us at sales@kicksense.com with your order number. Do this within 7 days of the stated delivery date so we can investigate with the carrier.

Shipping address
Please make sure your shipping address is correct at checkout. We’re not responsible for orders shipped to the wrong address if that’s the address provided to us.

Returns & Warranty Policy

Change of mind
We do not accept returns or offer refunds for change of mind, incorrect purchase, or general dissatisfaction if the product is working as intended.

Damaged or not working on arrival
If your product arrives physically damaged or will not function at all (for example it won’t power on, won’t charge, or cannot pair even after following the setup instructions), email sales@kicksense.com within 7 days of delivery with:

  • your order number

  • photos/video of the issue

  • a short description of what’s happening

We’ll review the case. If we confirm the unit is faulty or was damaged in transit, we’ll offer either:

  • a replacement unit at no cost, or

  • a refund of the purchase price

We may ask you to return the defective unit so we can inspect it. If we request a return for a confirmed defect, we’ll cover that return shipping.

Warranty (hardware)
KickSense hardware is covered by a limited warranty against defects in materials and workmanship for 12 months from the date of delivery. This covers normal use. It does not cover:

  • damage from misuse, abuse, or modification

  • cosmetic wear and tear

  • water damage beyond the stated resistance rating

  • damage caused by using non-approved charging cables, mounts, or straps

If you believe you’ve got a warranty issue within that 12 month window, contact us at help@kicksense.shop with proof of purchase and a description of the problem. We’ll tell you next steps.

When refunds are not available
We do not issue refunds if:

  • the product is working normally

  • the product was damaged after delivery due to normal play, mis-kicks, cleat impact, dropping, etc

  • you are returning a used, working device just because you don’t want it anymore

  • you had pairing issues caused by an unsupported / incompatible phone

Terms of Service

Overview
Thank you for using KickSense (“App”, “Service”). These Terms are a binding agreement between you and KickSense (“we”, “us”). By installing or using the App you agree to these Terms.

Who can use the App
You must be old enough to consent to data processing in your country and capable of forming a binding contract. If you’re using the App on behalf of an organization, you represent that you’re authorized to bind that organization.

Safety & No Medical Advice
KickSense provides motion analysis and training insights. It is NOT a medical device and does not diagnose, treat, or prevent any condition. Use common sense and consult a professional for health or training decisions.

Accounts & Content
Some features may require an account. You are responsible for your device, your account, and any data you upload (including videos and sensor recordings). Do not upload anything illegal or that you don’t have rights to share.

Acceptable Use
You agree not to:
a) reverse engineer or modify the App
b) use it to infringe intellectual property or privacy rights
c) interfere with our services or other users
d) attempt to access non-public features or data

Sensor & Video Data
The App can record motion sensor data (accelerometer, gyroscope, quaternions) and optional videos you capture. You control if/when to export, delete, or back up your data. See our Privacy Policy for how data is processed.

Third-Party Services
We may use third-party SDKs or services (for example analytics, crash reporting, cloud storage). Their use is subject to their own terms and privacy practices.

Fees
The App may offer paid features or subscriptions in the future. Any pricing and specific terms will be shown to you before purchase and handled by Apple App Store or Google Play policies.

Intellectual Property
The App, including software, UI, and content we provide, is owned by us or our licensors and protected by IP laws. You receive a limited, revocable, non-transferable license to use the App for personal, non-commercial purposes.

Termination
We may suspend or terminate access if you violate these Terms or if we discontinue the App. You may stop using and uninstall the App at any time.

Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA OR PROFITS. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE 12 MONTHS BEFORE THE CLAIM.

Indemnity
You agree to indemnify and hold us harmless from claims arising out of your misuse of the App or violation of these Terms.

Governing Law & Disputes
These Terms are governed by the laws of California, USA (without regard to conflicts of laws). Any disputes will be resolved in the state or federal courts located in California, and you consent to their jurisdiction.

Changes
We may update these Terms. Material changes will be communicated in-app or on our site. Continued use after changes means you accept the updated Terms.

Privacy Policy

Summary
We collect only what we need to provide motion analysis, improve the App, and support you. You control your videos and sensor logs. We do not sell your personal data.

Data We Collect

  • Account / Contact: name, email (if you provide it), support messages

  • Device & App Info: app version, OS version, device model, language, crash logs

  • Sensor Data: accelerometer / gyroscope / quaternion data you record, timestamps, optional metadata like the MAC address of your paired sensor (which we try not to persist beyond connection workflow)

  • Media: videos you capture in the App

  • Usage & Analytics: screens viewed, feature usage, performance metrics

  • Diagnostics / Logs: error traces to troubleshoot issues 

How We Use Data

  • Provide features (sensor pairing, logging, visualization, exporting)

  • Improve performance, safety, and reliability (analytics and crash reports)

  • Communicate with you (support, updates)

  • Comply with legal obligations and enforce our Terms


Legal Bases (EEA/UK)

  1. We process data as needed to perform a contract (provide the App), with your consent (for example notifications or certain analytics), and for our legitimate interests (improving and securing the App) where those interests do not override your rights

Sharing

  1. We share data with vendors who help us run the App (analytics, cloud storage, crash reporting). We require them to protect your data and use it only on our behalf. We may disclose information to comply with law, protect rights, or as part of a business transfer. We do not sell personal data.

Data Retention

  1. We keep data only as long as needed for the purposes above. You may delete in-app recordings, uninstall the App, or request deletion of support records by contacting us.

  2. International Transfers
    Your data may be processed in countries other than where you live. We use appropriate safeguards (for example contractual clauses) when required by law.

Your Choices & Rights

  • Access / Deletion / Correction: contact us to exercise your rights

  • Withdraw consent for optional features (like notifications) via system or in-app settings

  • Opt out of marketing emails using unsubscribe links (if we ever send marketing)
    Residents of the EEA/UK may object to processing or request restriction. California residents have CPRA rights including access, deletion, and non-discrimination.

Security
We use reasonable administrative, technical, and organizational measures to protect data. No method of transmission or storage is 100% secure.

Children
The App is not directed to children under the age where parental consent is required. Do not use the App if you are below that age.

Permissions We Use

  • Bluetooth: to discover and connect to supported sensors

  • Storage / Media (optional): to read and write exported CSVs and videos you capture

  • Camera / Microphone (optional): if you record videos in-app
    You can manage permissions in your device settings.

Third-Party Services
We may use platform services (Apple, Google), analytics, or crash reporting SDKs. Their privacy practices apply in addition to ours.

Changes
We may update this Privacy Policy. Material changes will be shown in-app or on our site. Your continued use means you accept the updates.
